🎓 REALTOR® vs. Real Estate Agent: Understanding the Ethical Difference
I recently took my annual Ethics Training class, a requirement for my position on our local Professional Standards Committee. As I reviewed the material, it struck me how important it is for everyone to understand the difference between the titles Real Estate Agent and REALTOR®. While both are licensed professionals, the distinction lies in a commitment to a mandatory ethical framework.
The Key Differentiator: The Code of Ethics
A licensed Real Estate Agent may or may not be a member of the local Board of REALTORS®. While access to the Multiple Listing Service (MLS) is often a benefit of membership, the defining feature of being a REALTOR® is the commitment to the National Association of REALTORS® (NAR) Code of Ethics. This Code consists of 17 Articles that hold members to a higher standard of conduct than what is required by state real estate licensing law alone.
The Enforcement Structure
I serve on the local Professional Standards Committee, which is responsible for enforcing this Code. Our role is to review cases brought by the public or other agents alleging a violation of one of the 17 Articles.
- Accountability: When a REALTOR® is found to have breached the Code, they are held accountable and sanctioned by their peers.
- Due Process: A formal hearing is conducted where a panel reviews testimony and evidence to determine if a violation occurred.
- Training: We are required to take an annual refresher course to ensure we are up-to-date on all changes and procedures related to the Code of Ethics. This process ensures accountability and due process for all parties.
The Guiding Philosophy: The Preamble
The Code of Ethics begins with a Preamble, which outlines the aspirational goals that guide the professional conduct of a REALTOR®. Two statements within the Preamble highlight this high standard:
- Stewardship of Land and Homeownership:
“Under all is the land… REALTORS® should recognize that the interests of the nation and its citizens require the highest and best use of the land and the widest distribution of land ownership.” This statement defines a professional obligation to encourage and facilitate responsible homeownership within our communities.
- The Golden Rule:
“In the interpretation of this obligation, REALTORS® can take no safer guide than that which has been handed down through the centuries, embodied in the Golden Rule, ‘Whatsoever ye would that others should do to you, do ye even so to them.’” This foundational principle serves as the moral guide for all interactions covered by the 17 binding Articles.
A Standard of Professionalism
While all 17 Articles must be followed during the practice of real estate, the spirit of the Code is meant to guide all professional interactions. The key takeaway is that the title REALTOR® signifies that an individual has agreed to be held accountable by their peers to an ethical framework dedicated to fair dealing and professional integrity—a standard that goes above and beyond the law.
